The following sets forth the privacy policy (“Privacy Policy”) of SuperMouth LLC (“we”, “our”, or “SuperMouth”) as it relates to information (referred to as “Personal Information” in this Policy) that we collect from you, as a user of the SuperMouth App, that identifies, describes, is reasonably capable of being associated with, or could reasonably be linked directly or indirectly with, you as an individual or your household.  We are committed to protecting consumer privacy by informing you of what Personal Information we collect, how we use it, and with whom we may share it.  We are also advising you of your rights to limit our right to use your Personal Information and to remove your Personal Information if you wish for us to do so.  For the purposes of this Privacy Policy, references to “you” and “your” mean and apply to persons who use the SuperMouth App.

What information do we collect?

We collect e-mail addresses from users of the SuperMouth App.  A valid e-mail address is needed for a user to open a SuperMouth Account and to use certain features of the app, such as to save avatars and game progress.  Other Personally Identifiable Information we collect from users with SuperMouth Accounts are the users’ address and credit card information. 

Additional information we collect from users of the SuperMouth App that may constitute Personally Identifiable Information in certain circumstances are the following:

  • IP Address
  • Device/Browser language
  • Operating system and its version
  • Device type
  • Webpages you have visited

If you want us to remove your Personal Identifiable Information from our records, you should follow the procedures in “Removing, Accessing, or Changing Information” below.

Unless you contact us via one of the contact forms on our website or open a SUPERMOUTH account, we do not collect any personally identifiable information about you.

How do we use your information?

Our website uses cookies to collect and use data. We use cookies for recording the number of visitors to our website; setting the order in which a visitor visits the various pages to our website; assessing which parts of our website or services need adaptation; and optimizing the website. How do we use the information we collect on our website?
With respect to the casual visitor to our website, we collect information to enable us to better understand the visitors who come to our website, what content on our Website is of interest to them and how certain features are used. We use this information for our internal analytics purposes and to improve the quality and relevance of our website. If you contact us through the contact form on the website and provide us with your name and email address, we may use that information to contact you to respond to your inquiry or market our ad services to you.

No information from third party sources obtained for website purposes
For purposes of visitors to our website, we do not obtain any information from third party sources.

Disclosure of information
We may share information about visitors to our website with services third-party service providers and partners who provide data processing services to us (for example, to support the delivery of, provide functionality on, or help to enhance the security of our website). Please note that we may be required to disclose information to third parties when obligated to do so by law and in order to investigate, prevent, or take action regarding suspected, or actual prohibited activities, including transfer reasonably intended to meet national security or law enforcement requirements, or when we believe in good faith that disclosure is necessary to protect our rights, including but not limited to fraud and situations involving potential threats to the physical safety of any person. In the event that we sell, merge or transfer all or part of its business, we may transfer visitor information to a third party as part of that transaction.

We may have links to other websites operated by others on our website. This Privacy Policy does not apply to these linked websites. Each website should be checked for its own privacy policy.

Data security
We take reasonable and appropriate measures to ensure that all data is kept secure including measures to prevent personal data from being accidentally lost, misused or accessed without authorization. This includes but is not limited to the use of firewalls and encryption. No method of transmission over the Internet or method of electronic storage is 100% secure; therefore, while we strive to use commercially acceptable means to protect your information, we cannot guarantee absolute security. Those processing your information will do so only in an authorized manner and are subject to a duty of confidentiality. We also have procedures in place to deal with any suspected data security breach. We will notify you and any applicable regulator of a suspected data security breach when we are legally required to do so.

How long we keep the data
We will hold data regarding website visitors and inquiries you make for 24 months and we do so only as necessary in relation to the purpose for which we collect data (see above for the reasons we collect data).

Removing, Accessing, or Changing Information

Removing Information for any User – Right To Be Forgotten
Any user, wherever located, can ask us to remove data consisting of their Personal Information collected by us through clicking on this link: https://SuperMouth.com/remove-your-data-opt-out, which we will do as permitted by law. You may also send an email to us at privacy@SuperMouth.com with your full name, your email address, and your IDFA (Apple Ad ID) or Google Advertising ID (GAID - Android) with a request to remove your Personal Information.  Notwithstanding any request we receive from you to remove your Personal Information, we may retain your Personal Information for purposes permitted under applicable law, such as to provide a service to or perform under a contract with you or to comply with data retention requirements mandated under those laws.

Right to Access/Know
Both of the California Consumer Privacy Act (CCPA) and General Data Privacy Regulation (“GDPR”) provide you with the right to know what Personal Information we obtain and retain concerning you. If you would like to know what Personal Information we have about you, email us at privacy@SuperMouth.com with your full name, your email address, and your IDFA (Apple Ad ID) or Google Advertising ID (GAID - Android) with a request to know what information we have about you. We will confirm your request within 10 days and make a good faith attempt to fulfill your request within 45 days.

Correction of Data
Depending on your location (e.g., you are resident in California or the EU) you have the right to have us correct any mistakes in your Personal Information that we possess. Please contact us at privacy@SuperMouth.com if you would like to request us to correct your Personal Information that is held by us.

Authorized Agent
You may have an authorized agent remove, access or change information pursuant to the instructions above. Please make sure to authorize only someone you trust to act as your authorized agent. We are not responsible for actions taken by your agent.

Nondiscrimination
You have a right not to be discriminated against if you exercise any of the rights you have to Remove, Access, or Change Information, as described above, and we will not do so.

Compliance with GDPR Article 6
Pursuant to the GDPR, where we are a controller of data, the legal basis for our collection of data will have both a legitimate interest and the consent of the users whose Personal Information is collected in accordance with Article 6 of the GDPR. The processing of your data is not high risk and will not violate fundamental human rights. We process personal data of clients for the performance of our contracts with them in accordance with Article 6 of the GDPR.
